About

Health law is a broad and complex field that governs healthcare providers, patient rights, health insurance, medical liability, pharmaceutical and medical device regulation, and public health. In Canada, it is shaped by multiple legal sources, including constitutional law, statutory law, common law, and regulatory frameworks. Given the layered nature of these legal sources, there are both commonalities and differences in how health law is applied across provinces. This variation raises important ethical questions, particularly regarding whether healthcare is held to consistent standards nationwide.

This symposium aims to explore the shared principles and key differences in health law across Canada. Key questions include

  • How do provinces interpret and implement the Canada Health Act differently?
  • Do patient rights vary across jurisdictions?
  • Are there significant differences in legal consequences, professional regulation, and liability?
  • What emerging issues are shaping the future of health law in Canada?

By examining these questions, this symposium seeks to deepen our understanding of how legal and ethical considerations influence healthcare across Canada.
